Terms of Service

1. Acceptance of Terms

By accessing or using MakoStack ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

MakoStack is operated by an independent developer ("we", "us", or "our"). We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms.

2. Description of Service

MakoStack is an AI-powered platform that enables users to create, customize, and publish web applications without coding. The Service includes:

  • AI-powered app generation from text descriptions
  • Visual editor for customizing app content and design
  • Chat-based editing for making changes to your apps
  • Hosting and publishing of apps on MakoStack subdomains
  • Form submission collection and management
  • Export functionality for generated code

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security of your password and account
  • Notify us immediately of any unauthorized use of your account
  • Be responsible for all activities that occur under your account

You must be at least 18 years old to create an account. By using the Service, you represent that you meet this age requirement.

4. User Content

"User Content" refers to any content you create, upload, or publish through the Service, including app configurations, text, images, and other materials.

Ownership: You retain ownership of your User Content. By using the Service, you grant us a limited license to host, display, and distribute your User Content solely for the purpose of providing the Service.

Responsibility: You are solely responsible for your User Content and must ensure it complies with our Content Policy and all applicable laws.

URL Import: When you provide a URL for content import, you represent that you own or have authorization to use the content from that website. MakoStack is not responsible for any intellectual property claims arising from content you import.

5. Prohibited Content and Conduct

You may not use the Service to create, host, or distribute any of the following:

  • Phishing and fraud: Fake login pages, credential harvesting, impersonation of banks, payment processors, or other services, advance-fee scams, or any content designed to deceive visitors into providing personal or financial information
  • Malware and hacking: Distribution of viruses, trojans, ransomware, keyloggers, exploit kits, or any tools intended for unauthorized access to systems
  • Illegal goods and services: Sale or promotion of controlled substances, weapons, counterfeit documents, stolen data, or any other illegal products or services
  • Financial scams: Ponzi or pyramid schemes, fake investment platforms, "get rich quick" schemes, unlicensed gambling operations, or cryptocurrency fraud
  • Impersonation: Pretending to be a government agency, law enforcement, or any business or individual you are not
  • Harassment and abuse: Content that threatens, bullies, doxxes, or targets individuals or groups
  • Adult and explicit content: Pornography, escort services, or sexually explicit material
  • Intellectual property violation: Content that infringes copyrights, trademarks, or other intellectual property rights of third parties
  • Spam and deceptive practices: Misleading claims, fake testimonials, bait-and-switch schemes, or unsolicited commercial content

You also agree not to:

  • Interfere with or disrupt the Service, servers, or networks
  • Attempt to gain unauthorized access to any part of the Service
  • Use automated systems (bots, scrapers) to access the Service without permission
  • Use the URL import feature to scrape or copy content from websites you do not own or have permission to use
  • Circumvent any content moderation or security measures
  • Create multiple accounts to evade enforcement actions

6. Sparks and Payments

The Service operates on a spark-based system. Sparks are required to generate new apps and may be required for certain premium features.

  • Sparks are non-refundable except as required by law
  • Unused sparks do not expire
  • We reserve the right to modify spark pricing at any time
  • All payments are processed securely through Stripe

7. Intellectual Property

The Service, including its design, features, and content (excluding User Content), is owned by MakoStack and protected by copyright, trademark, and other intellectual property laws.

Apps you create using the Service are yours. You may export and use the generated code as you see fit, subject to any third-party licenses that may apply to components used in the generated code.

8. Third-Party Services

The Service integrates with third-party services including:

  • Supabase - For authentication and database services
  • Stripe - For payment processing
  • Anthropic (Claude AI) - For AI-powered app generation
  • Google - For authentication (OAuth)
  • Vercel - For hosting and deployment

Your use of these services is subject to their respective terms of service and privacy policies.

9. Termination

We may terminate or suspend your account and access to the Service at any time, with or without cause, with or without notice. Reasons for termination may include:

  • Violation of these Terms
  • Violation of our Content Policy
  • Conduct that we believe is harmful to other users or the Service
  • Extended periods of inactivity

You may terminate your account at any time by contacting us. Upon termination, your right to use the Service will immediately cease.

10. Content Moderation and Takedowns

We employ a combination of automated scanning and human review to detect prohibited content on the platform.

  • Automated scanning: All published sites are automatically scanned for indicators of phishing, scams, malware, and other prohibited content. Flagged sites may be suspended immediately pending review.
  • Abuse reports: Anyone may report a site they believe violates these Terms using the "Report" button on any published site or by emailing makostackapp@gmail.com. We aim to review reports within 48 hours.
  • Takedown actions: We reserve the right to immediately remove, disable, or restrict access to any content or site that we determine, in our sole discretion, violates these Terms or poses a risk to our users, our platform, or third parties. We may act with or without prior notice to the site owner.
  • Account suspension: Repeated or severe violations will result in permanent account termination without refund.
  • Appeals: If you believe your site was removed in error, you may contact us at makostackapp@gmail.com with an explanation. We will review appeals in good faith but are not obligated to reinstate any content.
  • Law enforcement: We will cooperate with law enforcement agencies and comply with valid legal requests for information related to illegal activity on our platform.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAKOSTACK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

13. Indemnification

You agree to indemnify and hold harmless MakoStack and its operators from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the Service shall be resolved through good faith negotiation between the parties.
